Swift Way Route Planner

These Terms of Use (“Terms”) govern your access to and use of Swift Way Route Planner (the “App,” “Service,” or “Swift Way”) — a mobile application designed to assist users in planning, optimizing, and managing multi-stop delivery and logistics routes.

By downloading, installing, or using the App—available exclusively on the Apple App Store—you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please refrain from using the Service.

1. Eligibility

You must be at least 18 years of age or possess the legal capacity to enter into binding agreements under the laws applicable to you. Your use of the Service confirms your acceptance of these Terms and any associated policies.

2. Service Description

Swift Way provides tools for:

• Importing and processing location data (e.g., addresses, coordinates)
• Generating optimized delivery routes using algorithmic sequencing
• Visualizing, editing, and exporting route plans
• Managing delivery schedules and route history

The Service is intended for planning and operational coordination purposes only. It does not provide real-time navigation, live traffic rerouting, or turn-by-turn directions. Route suggestions are estimates based on available data and algorithms and may not reflect actual road conditions, legal restrictions, or accessibility. You are solely responsible for verifying route feasibility before execution.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, strictly for personal or internal business use.

You agree not to:

• Reverse engineer, decompile, or attempt to derive source code
• Reproduce, distribute, sublicense, or commercially exploit the App
• Use automated means (e.g., bots, scrapers) to access the Service
• Remove or obscure any copyright, trademark, or proprietary notices

4. Subscriptions and Billing

Certain features require a paid subscription (“Subscription”), available through the Apple App Store.

• Subscriptions are billed in advance and automatically renew unless auto-renewal is turned off in your Apple ID settings at least 24 hours before the end of the current period.
• All payments are processed by Apple, and all billing-related matters (including cancellations and refunds) are governed by Apple’s App Store policies.
• We do not issue direct refunds. To request a refund, contact Apple Support via your Apple account.
• Pricing may change. Any adjustments will apply only after your current billing cycle ends.

5. Free Trial

Eligible new users may receive a 7-day free trial of premium features. The trial:

• Requires a valid Apple ID with a payment method on file
• Automatically converts to a paid Subscription unless canceled before expiration
• Is limited to one per Apple ID

We reserve the right to modify or discontinue the trial offer at any time without notice.

6. Accuracy and Reliance Disclaimer

While we strive to provide accurate and efficient route planning, we do not guarantee:

• The correctness, completeness, or timeliness of geolocation or address data
• That suggested routes comply with local traffic laws or vehicle restrictions
• That routes are optimal for your specific vehicle type, cargo, or schedule

You acknowledge that use of the Service is at your own risk, and you assume full responsibility for operational decisions based on its output.

7. Intellectual Property

All content, software, visual interfaces, algorithms, and functionality within the App are our exclusive property or licensed to us. These Terms grant no ownership rights. Unauthorized use, reproduction, or distribution is strictly prohibited.

8. Third-Party Services

The App may rely on or link to third-party mapping, geocoding, or analytics services (e.g., Apple Maps). We are not responsible for the availability, accuracy, or privacy practices of such services. Use them at your own discretion.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including lost profits, delivery delays, or business interruption—arising from your use of or inability to use the Service.

Our total liability for any claim related to the App is limited to the amount you paid (via Apple) in the six (6) months preceding the claim.

10. “As Is” Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DISCLAIM ALL WARRANTIES REGARDING UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR DATA ACCURACY.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if your use threatens system integrity or other users. Termination does not entitle you to a refund for any prepaid subscription period.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles. Any legal action arising from or related to these Terms shall be brought exclusively in the state or federal courts located in Delaware.

Note: Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence, where such laws cannot be waived by contract.

13. Modifications

We may update these Terms periodically. Material changes will be communicated via in-app notice or email (if provided). Continued use after such notice constitutes acceptance. If you object, discontinue use immediately.
